After giving a client an FSG, but before providing the advice, a licensee changes its fee structure. What may it do to keep the client's disclosure up to date?
Section 941F of the Corporations Act 2001 (compilation 19 Sep 2026) requires an updated FSG where there is a relevant change in circumstances before the service is provided, and a Supplementary FSG containing the updated information may be given for this purpose (ss943A-943D; s943D treats its information as included in the FSG). Oral notice after the service, or lodging with ASIC, does not meet the obligation.
FSG accuracy matters at the time of the service, not just when it was handed over.
